This Privacy Policy describes how GOODWALK HOLDINGS, LLC (“GOODWALK,” “we,” “us,” or “our”) collects, uses, shares, and protects information about you when you visit our website at haveaGOODWALK.com, use our mobile app, visit our studios, take classes, or otherwise interact with us. By using our services, you agree to the practices described in this Policy.

1. Who We Are

GOODWALK HOLDINGS, LLC is a Delaware limited liability company operating boutique walking fitness studios. Our studios at 1371 H Street NE, Washington, DC and 1831 Michael Faraday Drive, Reston, VA are located within facilities operated by FLEX DC LLC (“FLEX”) under a strategic partnership and rental arrangement. GOODWALK is the controller of all member personal information collected in connection with GOODWALK classes, memberships, and communications. FLEX is not authorized to access, use, or retain GOODWALK member data except as described in Section 6 of this Policy.

2. Information We Collect

We collect information you give us directly, information collected automatically when you interact with us, and information from third parties.

2.1 Information You Provide

  • Account information: name, email address, phone number, date of birth, mailing address, emergency contact, and account password.

  • Payment information: credit or debit card details, billing address, and transaction history. Payment card data is processed and stored by our payment processor, Stripe, Inc. We do not store full payment card numbers on our systems.

  • Health and fitness information: information you choose to share through waivers, intake forms, instructor conversations, or in-class interactions, including injuries, pregnancy status, medical conditions you disclose, and fitness goals. We treat this information with heightened care. We do not require it except where reasonably necessary for safety.

  • Class and membership activity: classes booked, attended, canceled, or missed; treadmill preferences; class theme preferences; membership tier; and communications with our staff.

  • Community and app interactions: your username, profile photo, posts, comments, likes, reactions, and any other content you share through our app or in-studio community features.

  • Childcare information (if applicable): if you use our childcare service, we collect your child’s name, age, your contact information, pickup authorizations, and any allergies or care notes you provide. We do not knowingly market to children, and children do not have GOODWALK accounts.

  • Marketing and survey responses: information you provide when you sign up for email lists, respond to surveys, refer friends, or participate in founding member programs.

2.2 Information Collected Automatically

  • Device and usage information: IP address, browser type, operating system, mobile device identifiers, referring URL, pages viewed, links clicked, and time spent on pages.

  • Cookies and similar technologies: we and our service providers use cookies, pixels, local storage, and similar technologies to remember your preferences, analyze usage, and (where you have consented or where permitted by law) deliver advertising. See Section 8 for more on cookies and your choices.

  • Location information: approximate location derived from IP address. We do not collect precise GPS location unless you grant the mobile app permission to do so.

  • In-studio video: FLEX operates the physical studio premises and may maintain security cameras at the studio. Footage is controlled by FLEX, not GOODWALK. GOODWALK may receive footage from FLEX only for documented operational or safety purposes consistent with our agreement with FLEX.

2.3 Information from Third Parties

  • Service providers: our studio management platform (Walla Software, Inc.) and payment processor (Stripe, Inc.) provide us with information necessary to operate your account and process transactions.

  • Marketing partners: if you find us through a referral, social media campaign, or partner (such as a corporate wellness program, a senior living community, or a university partnership), we may receive limited information about how you reached us.

  • Public sources: we may collect publicly available information from social media platforms where you have tagged us or interacted with our content.

3. How We Use Your Information

We use your information for the following purposes:

  • To create and manage your account, process payments, and deliver the classes and services you sign up for.

  • To communicate with you about your account, bookings, class changes, waitlists, and customer service requests.

  • To send you marketing communications about GOODWALK classes, events, promotions, and community programming, subject to your right to opt out.

  • To personalize your experience, including class recommendations, instructor pairings, and content within our app.

  • To operate community features in our app, such as social posts, member milestones, class roster visibility, and post-class events.

  • To analyze and improve our classes, programming, marketing, and operations, including measuring retention, attendance patterns, and member satisfaction.

  • To run automated analytics through our studio management platform (Walla), including predictive analytics that estimate the likelihood a member may stop attending so that we can reach out and re-engage. These analytics inform our outreach to you; they do not by themselves make decisions that produce legal or similarly significant effects.

  • To protect the safety of our members, staff, and studios, including investigating incidents, enforcing our rules, and responding to emergencies.

  • To comply with legal obligations, respond to lawful requests, and protect our legal rights.

4. Legal Bases for Processing

Where required by applicable law, we process your personal information on the following legal bases: to perform our contract with you (for example, to deliver classes you have paid for); with your consent (for example, for marketing emails and for sensitive health information); to comply with legal obligations; and for our legitimate interests in operating, improving, and securing our business, where those interests are not overridden by your rights.

5. How We Share Your Information

We do not sell your personal information. We share your information only as described below.

Important: We do not share, sell, or transfer mobile phone numbers or SMS consent information with any third party or affiliate for that party’s own marketing or promotional purposes. The sharing described in this section does not apply to mobile phone numbers collected for text messaging or to SMS opt-in data, except as needed to operate our own SMS program. See Section 9 (SMS / Text Message Communications) for details.

5.1 Service Providers

We share information with vendors that help us operate GOODWALK, under contracts that restrict their use of your information to providing services to us. Key service providers include:

  • Walla Software, Inc. (studio management platform, branded app, scheduling, reporting, predictive analytics).

  • Stripe, Inc. (payment processing).

  • Email and SMS providers, analytics providers, and customer support tools (used to send communications and analyze website and app usage).

  • Hosting, security, and infrastructure providers.

5.2 FLEX (Our Studio Partner)

Our studios operate inside FLEX facilities. FLEX is a separate company. Under our agreement with FLEX, FLEX is not permitted to access, copy, use, or retain GOODWALK member data, except as strictly necessary for facility operations and only with our prior written consent. Limited operational information (for example, the fact that a member is checking in at a specific studio) may be visible to FLEX staff present at the front desk. FLEX is responsible for the physical security and condition of the premises and for any security cameras it operates on-site.

5.3 Other Members

If you participate in our app’s community features, your profile information, posts, and interactions will be visible to other GOODWALK members. Do not share information through community features that you do not want other members to see. You can adjust your visibility settings within the app.

5.4 Legal and Safety

We may share information when we believe it is reasonably necessary to: (a) comply with applicable law, legal process, or government requests; (b) enforce our agreements or investigate potential violations; (c) protect the rights, safety, or property of GOODWALK, our members, or others; or (d) respond to an emergency.

5.5 Business Transfers

If GOODWALK is involved in a merger, acquisition, financing, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.

5.6 With Your Consent

We may share information with other parties when you direct us to do so or otherwise consent.

6. Specific Data Scenarios

6.1 Health and Sensitive Information

Information you share about pregnancy, injuries, medical conditions, or other health matters is treated as sensitive. We use it only for the purpose you share it for (typically, your safety and class experience), and we do not use it for marketing or share it outside the staff who need it. We do not knowingly sell sensitive personal information. We do not process sensitive personal information for purposes of targeted advertising.

6.2 Founding Members and Pre-Launch Information

If you provide your information through our founding-member program, waitlist, or pre-launch interest forms, we use that information to communicate with you about GOODWALK’s launch, founding-member offers, and class availability. You can opt out of these communications at any time using the unsubscribe link in any email.

7. How Long We Keep Your Information

We keep your information for as long as your account is active and for a reasonable period afterward to: (a) comply with legal, tax, and accounting obligations; (b) resolve disputes; (c) enforce our agreements; and (d) understand and improve our services. When we no longer need your information, we delete it or anonymize it. You can request deletion of your account at any time as described in Section 10.

8. Cookies, Analytics, and Online Advertising

We use cookies and similar technologies for three purposes:

  • Strictly necessary: to operate the website and app, log you in, process payments, and remember your booking session. These cannot be turned off.

  • Analytics: to understand how visitors and members use our website and app, so we can improve them. We use providers such as Google Analytics. You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout.

  • Advertising and social media: to measure the performance of our ads and show you GOODWALK content on platforms such as Meta (Facebook and Instagram), TikTok, and Google. These technologies share limited information about your interactions with our website with the advertising platform.

You can control cookies through your browser settings. Many browsers also offer a “Do Not Track” signal; because there is no industry-standard interpretation, we do not currently respond to Do Not Track signals. We do honor recognized Global Privacy Control (GPC) signals where required by law as a request to opt out of sale or sharing of personal information for cross-context behavioral advertising.

9. SMS / Text Message Communications

If you provide us with your mobile phone number and consent to receive text messages from GOODWALK, we may send you messages about your account, bookings, class reminders, waitlist confirmations, schedule changes, and (with separate consent) marketing communications about GOODWALK classes, events, and promotions.

9.1 Consent

By providing your mobile phone number on a GOODWALK website form, app, or in-studio check-in screen and checking the SMS opt-in box, you consent to receive recurring automated text messages from GOODWALK at the number provided. Consent is not a condition of purchase or membership. Message and data rates may apply. Message frequency varies depending on your activity and the messages you have opted into.

9.2 Opt-Out

You can opt out of receiving text messages from us at any time by replying STOP to any text message from GOODWALK. After you send STOP, we will send one confirmation message and will not send you further marketing texts unless you opt back in. You may continue to receive transactional or service messages where required (for example, confirmation of a class cancellation). For help, reply HELP or email [email protected].

9.3 No Sharing of Mobile Data for Marketing

Mobile phone numbers and SMS consent information collected by GOODWALK are never sold, shared, or transferred to third parties or affiliates for their own marketing or promotional purposes. We share mobile phone numbers and SMS consent data only with the service providers that operate our text messaging infrastructure on our behalf (for example, our studio management platform and its underlying messaging carriers), and only as necessary to deliver messages from GOODWALK to you. Any sharing of personal information described elsewhere in this Policy excludes mobile phone numbers collected for SMS and SMS opt-in data.

9.4 Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. GOODWALK is not responsible for any delays, failures in delivery, or other issues related to the transmission of text messages.

10. Your Rights and Choices

Depending on where you live, you may have the following rights regarding your personal information:

  • Access: request a copy of the personal information we hold about you.

  • Correction: ask us to correct inaccurate or incomplete information.

  • Deletion: ask us to delete your personal information, subject to certain legal exceptions.

  • Opt-out of marketing: unsubscribe from marketing emails using the link in any email, or text STOP to opt out of SMS marketing. You will continue to receive transactional messages (such as booking confirmations) necessary to provide the service.

  • Opt-out of targeted advertising and sale/sharing: where required by law, opt out of the sharing of personal information with advertising platforms for cross-context behavioral advertising.

  • Limit use of sensitive personal information: where required by law, ask us to limit the use of sensitive personal information to what is necessary to provide the service.

  • Appeal: if we decline a request, you may appeal by contacting us at [email protected]. Virginia residents may also contact the Virginia Attorney General.

To exercise any of these rights, email [email protected] or contact us using the details in Section 14. We will respond within the timeframe required by applicable law (generally 45 days, with one extension permitted where reasonably necessary). We will verify your identity before fulfilling certain requests, typically by confirming information you have already provided to us. We will not discriminate against you for exercising your rights.

10.1 Virginia Residents

Under the Virginia Consumer Data Protection Act, if you are a Virginia resident you have the rights described above. We do not sell personal information for monetary consideration. We may share limited personal information with advertising partners for cross-context behavioral advertising; you may opt out at [email protected]. We do not process personal information for profiling in furtherance of decisions that produce legal or similarly significant effects without your consent.

10.2 District of Columbia Residents

We comply with the District of Columbia Consumer Protection Procedures Act. You may contact us at [email protected] with questions or complaints, and you may also contact the District of Columbia Office of the Attorney General.

10.3 Other U.S. State Residents

Residents of other U.S. states with comprehensive privacy laws may have rights similar to those described above. Contact us at [email protected] to exercise applicable rights.

11. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your information, including encryption in transit, access controls, and vendor due diligence. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you and applicable regulators as required by law.

12. International Users

GOODWALK operates in the United States. Our services are intended for U.S. residents. If you access our services from outside the U.S., your information will be transferred to, stored, and processed in the U.S., where data protection laws may differ from those in your country.

13. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will notify you by email, through the app, or by posting a prominent notice on our website before the changes take effect. Your continued use of our services after the effective date of the updated Policy means you accept the updated terms.
